Anwar’s trial adjourned briefly due to blackout at court complex

KUALA LUMPUR: A blackout at the Court Complex at Jalan Duta disrupted Opposition leader Datuk Seri Anwar Ibrahim’s sodomy trial.

The courtroom was plunged into darkness at about 11am, just as the fifth prosecution witness in the trial, Chemistry Department Serious Crime Unit head Dr Seah Lay Hong, was called to the stand.

At about 11.20am, Justice Mohamad Zabidin Mohd Diah adjourned the case to 2pm.

Power was restored to some courtrooms, but the air-conditioning and recording system of High Court 3 where the Anwar trial was being held, was still affected, leading Justice Mohamad Zabidin to adjourn the case to today.

Speaking to reporters outside the courtroom after the first adjournment, Anwar’s lead counsel Karpal Singh requested that the Attorney-General withdraw the sodomy charge after it was revealed in court that the sodomy and oral sex complaint against him had been listed as “attempted” in complainant Mohd Saiful Bukhari Azlan’s medical proforma. Karpal Singh said the charge should be dropped as there was no basis for it.

Earlier in court, Hospital Kuala Lumpur Emergency Care Specialist Dr Khairul Nizam Hassan agreed that the proforma had stated “attempted” sodomy and oral sex.

“Then there could not have been penetration. It says here, attempted,” Karpal said, when grilling Dr Khairul.

The doctor, however, clarified that the patient did not use the word “attempted” when he was interviewed by the doctors prior to his medical examination.

Karpal: But he said it. It’s in the proforma!

Dr Khairul: The proforma is only a guide.

Karpal: The proforma would be based on what he (Mohd Saiful) said.

Dr Khairul: He did not say the word “attempt”.

Anwar, 63, has been charged with performing carnal intercourse against the order of nature on Mohd Saiful at a condominium unit in Bukit Damansara, Kuala Lumpur, between 3.15pm and 4pm on June 26, 2008.

Leading the prosecution is Solicitor-General II Datuk Mohd Yusof Zainal Abiden.

Karpal also pointed out that the prosecution’s evidence was contradictory as the proforma also stated that there was ejaculations for both “oral attempted” and “rectal attempted”.

It also stated that there was “full penetration”, with a 30-minute coitus duration.
