MIRI: A self-employed man was jailed 28 years and ordered to be whipped 16 times by the Miri Sessions Court after he pleaded guilty to repeatedly raping his eldest daughter, aged 15.
Mohd Sapie, 36, who has two wives and is a father of four children, pleaded guilty Tuesday to two counts of raping his daughter in their house last week.
Judge Musyiri Peet imposed a jail term of 14 years and eight strokes of the rotan for each offence and ordered the sentences to run consecutively.
Prosecuting officer Insp Siti Hajar Jaafar said the accused was arrested on April 19 after the victim lodged a police report.
The court was told that the victim had been repeatedly raped since she was 12. The latest incident happened on April 19 at 4am in their house.
“The victim said her father forced himself on her while she was sleeping. She tried to resist him but he forced himself on her until she could hardly breathe,” Siti told the court.
The victim, a Form Three student, told her mother about the rape incidents after she left the house on April 19.
Both of them went to the Miri Central Police Station and lodged a report. The man was arrested at 2.30pm the same day.
The court heard that the victim feared for her sister.
The victim has a five-year-old sister and two brothers aged three years and eight months.
Mohd Sapie, who was unrepresented, pleaded for leniency but the prosecution asked for a deterrent sentence.
Musyiri said the court had to impose a tough sentence to reflect the severity of the crime.
