KUALA LUMPUR: Under the common law system, which upholds the doctrine of binding precedent, a lower court cannot overturn a superior court judgment.
Lower court judges can disagree with the judgment but they are bound to follow it, said Dr Shad Saleem Faruqi, professor of law at Universiti Teknologi Mara yesterday.
