PUTRAJAYA: Terengganu Umno deputy chairman Datuk Idris Jusoh has won his appeal to obtain an interim injunction against Mentri Besar Datuk Seri Abdul Hadi Awang and five others from continuing to defame him.
Court of Appeal judges Justices Hashim Mohd Yusoff and Tengku Baharudin Shah Tengku Mahmud and High Court judge Justice Low Hop Bing set aside a decision by the Terengganu High Court which dismissed Idris interparte application.
Idris had appealed against the High Courts decision on Feb 14 to dismiss the application, with cost, for an interlocutory injunction filed three days earlier.
Hadi and five others PAS secretary-general Nasaruddin Mat Isa, Warta Darul Iman chief editor Mohamed Jusoh, Harakah editor Zulkifli Sulong, Harakah publisher Angkatan Edaran ENT Sdn Bhd and Pencetakan Yayasan Islam Terengganu Sdn Bhd were named as respondents in the appeal.
High Court judge Justice Ahmad Maarop had said he could not conclude on the accuracy of the reports that allegedly defamed Idris, which were published in the state governments paper Warta Darul Iman on Jan 11 and in PAS official organ Harakah on Jan 16.
He held that the accuracy of the reports could only be ascertained in a full trial.
In his oral judgment, Justice Hashim said the High Court had erred when it refused to grant the injunction to Idris.
He said no material had been put forward to the Court of Appeal that showed Jusoh Enterprises Sdn Bhd, Idriss family company, had obtained government contracts funded by Dana Khas Wang Ehsan (compassionate payment) scheme as indicated by the reports.
There is no nexus between the contracts awarded and the wang ehsan. In fact, there was evidence to show that one contract in July 1999 had been awarded even before the issue of wang ehsan arose, he said.
Therefore, the words uttered by Hadi were untrue, Justice Hashim added.
