KUALA LUMPUR: The High Court has fixed Sept 3 to mention an application of stay of proceedings by businessman Datuk Tan Kim Hor against Tan Chong Motor Holdings.
Justice Zainun Ali who postponed the matter had fixed the date in chambers yesterday.
Kim Hor had applied for stay of all proceedings pending an appeal at the Court of Appeal of the dismissal of Justice Zainun from hearing his suit.
The application to discharge Justice Zainun from hearing his suit was the second filed by Kim Hor.
On Oct 23 last year, the High Court dismissed with costs his application to stop Justice Zainun from hearing his suit.
This application arose out of a suit that Kim Hor had filed against Tan Chong Motor Holdings Bhd chairman Datuk Tan Heng Chew, Tan Chong Motor Holdings Bhd and its four subsidiaries seeking to stop the four subsidiaries from removing him as director.
On March 11, Kim Hor had instructed his lawyer to withdraw the suit but this was met with objections from the defendants’ lawyers who urged the court to deal with the application for leave to cite Kim Hor for contempt.
No date has been fixed for the appeal yet.
