No death penalty for juveniles


Juvenile offenders found guilty under Section 302 of the Penal Code for murder cannot be sentenced to death but will be detained in prison under the pleasure of the Yang di-Pertuan Agong, under Section 97 of the Child Act 2001, which prohibits death sentences against child offenders. Universiti Kebangsaan Malaysia (UKM) family law, women and children expert Datuk Noor Azizah Mohd Awal said the Prison Board of Visiting Justices determines the detention period based on the juvenile's progress. She also pointed out that under the Child Act 2001 juvenile offenders will not have a criminal record, unlike adults. Seven youths aged between 11 and 18 have been remanded until Sept 22 in connection with the deadly fire at the Darul Quran Ittifaqiyah school last Thursday which claimed 23 lives. The case is being investigated under Section 435 of the Penal Code for mischief by fire and Section 302 for murder.
