THE appointment and termination of a councillor is governed by the Local Government Act 1976, says local government expert Derek Fernandez.
He said S10 of the Act states that the State Authority, and not any individual, has the power to appoint or revoke the appointment of councillors. Such a decision must be taken by a majority of the exco and consented to by the ruler, who collectively make up the State Authority under the law.
