Tribunal dismisses woman’s RM3,000 claim against caterer over lack of food

Johor Baru Consumer Claims Tribunal dismissed a housewife’s claim for RM3,000 against a caterer for failing to deliver satisfactory services at her children’s wedding.

Khalidah Johari, from Kampung Air Merah, Mersing, Johor, who was dissatisfied with the caterer’s services, filed a case with the tribunal.

Khalidah had hosted two weddings simultaneously – for her son and daughter.

The breakdown for the RM3,000 claim was RM2,400 for not getting the food ordered and RM600 for shame and embarrassment suffered.

The claimant said she had ordered food for 400 guests, priced at RM12 per person, totalling RM4,800 for the wedding on Dec 16, 2023.

“The wedding lunch started at noon but the main table for both couples was not even ready at 12.08pm,’’ said the 60-year-old claimant during the hearing before tribunal president Hafez Zalkapli.

The claimant said 120 guests turned up for lunch at noon and the food had run out by 12.45pm.

Khalidah said besides buying fried chicken, she had to serve guests dishes cooked by her family.

She claimed that the respondent delivered three instead of four containers of rice, which was not enough to feed her guests.

“The RM600 claim is for causing shame and embarrassment as the respondent had ruined the wedding lunch,” she said.

After hearing from the respondent, however, Hafez dismissed Khalidah’s claim.

Respondent Faridah Khalid, 54, when met, said the claimant ordered food for 400 guests at an agreed price of RM4,800.

“She also ordered dishes for the main table for the wedding couples and desserts of bubur kacang and terigu for guests,” said the respondent.

The proprietor of Gee Catering and Supplier in Mersing said the extra orders raised the amount to RM5,200 from RM4,800.

Faridah said the RM12 per person price was for nasi minyak, white rice, ayam masak merah, daging briyani, acar timun, oranges, two types of kuih and syrup drink.

“The extra dishes, for the main table, were ikan masak tiga rasa and prawns for eight guests (including the brides and grooms),” she added.

She admitted that she delivered three containers of rice but the 10kg rice in each container was sufficient for 150 guests.

“I asked the claimant many times whether the food ordered was enough for 400 guests.

“I also advised her to order extra for another 100 guests including children,’’ said the respondent, who has been in the catering business for over 30 years.

Faridah said the claimant paid a RM200 deposit before paying RM3,000 via online bank transfer and RM2,000 on Dec 16, 2023.
