‘Lodging report is not sabotage’

PETALING JAYA: The purpose of lodging a police report is to enable the police or other agencies to start investigations into complaints contained in the police report, said lawyer Matthias Chang.

Lodging police reports could not amount to sabotage as what he and former Batu Kawan Umno vice-chief Datuk Seri Khairuddin Abu Hassan had been recently charged with, he added.

“Deputy Public Prosecutor for the case Masri Mohd Daud and his colleagues in court seemed focused on the gravity of the charge of sabotage, and the use of the Security Offences (Special Measures) Act 2012 (Sosma),” said the lawyer for Khairuddin in a press statement yesterday, on his website futurefastforward.com

On Monday, Khairuddin and Chang were charged in the magistrate’s court under Section 124L of the Penal Code, read with Section 34, for attempting to sabotage the coun­­try’s banking and financial services.

Both pleaded not guilty to the charge.

During the proceeding, Mohd Masri asked the court for a month to prepare the relevant documents to sanction the charge under Sosma.

Magistrate Siti Radziah Kamardin fixed Oct 26 for re-mention of the case.

On Tuesday, Attorney-General Tan Sri Apandi Ali – in answering criticisms about the use of Sosma on the two – said in a press conference that the use of security laws against Khairuddin and Chang were not an abuse of po-wer.

He added that the two were charged under the Penal Code and not Sosma, which was only a procedural law to facilitate investigations and prosecution.

Apandi said Sosma was aimed at terrorism and offences against the country, but could be exten-ded to the fight against organised crime, human trafficking and more.

“The list can be extended as necessary,” he added.
