Former workers sue telco firm for RM22mil

IPOH: Some 476 ex-workers of Time dotCom Bhd are suing their former employer for more than RM22mil over the sale of the company in 2009 without their knowledge.

The plaintiffs claimed that the company had kept the move secret to avoid paying termination and layoff benefits, and caused them to lose their jobs in 2010. The suit was filed in the High Court here yesterday through their counsel Vengetraman Manickam, with Norma Taharim, the spokesperson for the group, named as the lead plaintiff.

In their statement of claim, the group who worked in various capacities in Time Reach Sdn Bhd, a subsidiary telecommunications company wholly owned by Time dotCom, said the loss-making payphone operator (Time Reach) was sold to Paycomm Sdn Bhd without their knowledge in 2009.

The workers throughout the country, including Sabah and Sarawak, are claiming for compensation for loss of work and other employment-related benefits amounting to RM22,223,996.85 effective April 15, 2009.

Vengetraman said the workers were making claims from the time they started working in the company, which varied between 20 and 30 years, to the time the company was sold off to Paycomm.

Norma claimed the workers only knew in 2012, when some of them filed a case with the Industrial Court, that the company was sold to Paycomm, through details with which Time dotCom had furnished the court.

She also claimed that a year after working with Paycomm, the company terminated their services on Nov 25, 2010, citing that it had no funds due to a loss in business.

She added that they were not paid their salaries six months prior to their termination. She claimed that to avoid paying their salaries, money from the company was siphoned off, and the company sold to Paycomm for RM8.3mil.

Vengetraman noted that the Industrial Court had in May ordered Paycomm to pay RM1.7mil to 37 of the workers in Perak. The payment had yet to be made.
