PUTRAJAYA: The Court of Appeal has dismissed an appeal by the prosecution in a case of five family members charged with stealing various cosmetic products worth more than RM2,000.
Justice Mohtarudin Baki, who chaired the three-man panel, made the decision after allowing preliminary objection by counsel Datuk Ahmad Zaidi Zainal who acted for the five.
“We find that failure by the prosecution to plead constitutional issue in the appeal notice is fatal, which causes this appeal to be dismissed. Decision by the High Court is upheld.
“I hope it will serve as a lesson to you (five respondents). Why the need to steal when you are already bestowed with beauty,” said Justice Mohtarudin in a unanimous decision yesterday. Other judges on the panel were Justices Zakaria Sam and Kamardin Hashim.
The Johor Baru High Court has ordered Rohaya A. Rahman, 58, her three daughters Noriza Che Abdullah, 39, Maimunah, 27, and Nurul Fatihah, 20, and her daughter-in-law Zariah Zakaria, 38, to be bound over on a two-year good behaviour bond.
