KUALA LUMPUR: A warrant of arrest has been issued against two company directors who failed to attend court proceedings in relation to income tax payments of their staff.
The two are Johari Mohd Noh, 63, from shipping company Gagasan Carriers Sdn Bhd, and Aminuddin Bushra, 51, of IT company Majesco Sdn Bhd.
In a statement, the Inland Revenue Board (IRB) said both men were to appear in court to answer charges under Section 120(1)(e) of the Income Tax Act 1967, for failing to pay the taxes of its employees.
The IRB said under subsection 83(5) of the Act, employers are required to pay taxes from money or benefits withheld by the employer for employees who are leaving Malaysia with no intention of returning.
If convicted, the company directors will be liable for a jail term of up to six months, or a maximum fine of RM20,000, or both.
Magistrate Zuhair Rosli fixed June 15 for mention following the failure of the two men to appear in court yesterday.
