KUALA LUMPUR: A High Court has set June 27 to hear MIC’s bid to be an intervener in the application for leave by former party strategic director K. Ramalingam and seven other members to initiate judicial review proceedings against the Registrar of Societies (RoS).
On Monday, lawyer Ho Hon Keong, who appeared for MIC, said High Court judge Justice Hanipah Farikullah fixed the date to hear the intervener application.
The applicants' lawyers David Mathews and L.Prakash confirmed the matter.
Speaking to reporters after the parties met the judge in chambers, Mathews said they would object the application for an intervener on grounds that MIC has no interest in the matter.
"There are no allegations against MIC as a party and we are not challenging any decision of MIC. Therefore, MIC has no interest and should not intervene," he added.
In their application for leave, the eight applicants want an order to set aside the findings, decision and directions of RoS in four letters that were issued to the MIC.
The eight are also applying for damages, costs and further relief deemed fit by the court.
Mathews had said that the judicial review was aimed to set aside decisions and directives of RoS pertaining to the nullification of 2013 MIC elections and ordering of the 2013 re-elections for the party.
In the application for leave filed in March this year, the seven other applicants are V. Ganesh, Datuk Henry Benedict Asirvatham, M. Sathiyamurthi, George Alexander Fernandez, R. M. Prabu, R. Sithambaram Pillay and Datuk M. V. Rajoo.
They have named RoS, its director-general Mohammad Razin Abdullah and RoS officer Akmal Yahya as respondents.
The applicants said they have also filed a civil action on Feb 5 against MIC president Datuk Seri Dr S. Subramaniam, Mohammad Razin, Akmal and several others over an alleged conspiracy to topple Datuk Seri G. Palanivel as president of MIC.
