GEORGE TOWN: A former Penang Municipal Council (MPPP) consultant engineer has succeeded in getting a stay for a RM1.75mil fine imposed on him for receiving a RM350,000 bribe.
High Court judge Zamani Abdul Rahim allowed Chua Beng Seong’s application for the stay in chambers yesterday pending the hearing of his appeal against his sentence and conviction.
Chua, 55, had been ordered by the Sessions Court to pay the fine in monthly instalments of RM250,000 starting from Feb 15.
The lower court had found him guilty on Jan 27 of committing the offence when he was a consultant engineer for the MPPP.
He was convicted of accepting RM350,000 from Khasal Jaya Sdn Bhd managing director Khairul Adnan Hashim at the lobby of Menara BHL in Jalan Sultan Ahmad Shah at 10.45am on July 8, 2009, as a fee for proposing that Khasal Jaya be given the tender for infrastructure upgrading work at the Bayan Lepas Industrial Zone and Technoplex.
Chua was then the consultant engineer for CBS Consultant Engineering Sdn Bhd appointed by MPPP to carry out the upgrading work.
Sessions judge Sitarun Nisa Abdul Aziz had also sentenced Chua to three years in jail but allowed a stay of execution pending appeal, with bail set at RM300,000 in one surety.
