Chief Justice Arifin Zakaria ruled that the conduct of the Commission was inextricably linked to the elections and could not be questioned in a civil court.
Under Article 118 of the Federal Constitution, questions of conduct related to general elections can only be challenged through an election petition. And such petitions need be heard before a specialised election court.
