KOTA BARU: The two Private Member’s Bills which would pave the way for hudud to be implemented in Kelantan have not been put on hold – they could still be tabled in September.
Deputy Mentri Besar Datuk Mohd Amar Abdullah said several issues had to be resolved first before the Bills were presented in Parliament.
Mohd Amar, a member of the national-level hudud technical committee and head of the state-level committee, said the Bills had not been put on hold and could be tabled in the September parliamentary meeting.
“We cannot jump the gun because we need to have the outcome from the national committee. It will make the final conclusion on the matter,” he said after the weekly state executive council meeting at Kota Darul Naim here yesterday.
Mohd Amar added that the Kelantan government had not yet set a date to enforce the syariah criminal code.
On Sunday, PAS president Datuk Seri Abdul Hadi Awang had announced that the tabling of the Bills in Parliament would not be carried out during the Dewan Rakyat meeting next month.
He said the postponement was to give sufficient time to the joint federal-Kelantan technical committee to study the implementation of the Kelantan Syariah Penal Code II.
The first Bill aims to provide wider powers to syariah court judges to hear and mete out sentences under the syariah penal code while the other is to allow the use of federal authorities, such as police and the Prisons Department, to enforce these laws because currently, under Article 76A of the Federal Constitution, laws governing theft, robbery, causing hurt, rape and murder come under the jurisdiction of the Penal Code.
Mohd Amar said PAS was banking on Minister in the Prime Minister’s Department Datuk Seri Jamil Khir Baharom to table the two Bills.
He added that Parliament regulations required a full minister to table the motion to present the Bills and be seconded by 15 MPs.
Mohd Amar said he had the names of the national hudud technical committee members but declined to say who they are.
