KUALA LUMPUR: DAP leader Lim Kit Siang has intentionally or unintentionally misconceived the High Court judgment over the acquittal of Tun Dr Ling Liong Sik of the three charges of cheating the Government.
MCA deputy president Datuk Seri Liow Tiong Lai (pic) said Lim had done so to the detriment of both Ling and the MCA as a whole. “Lim has misled the public as the judgment, as reported, does not warrant any conclusion of “immunity on dereliction of duty’ as claimed by him,” Liow pointed out.
On Friday, Dr Ling, the former Transport Minister, was acquit-ted, in a 42-page written judgment delivered by Justice Ahmadi Asnawi, of cheating the Government in the Port Klang Free Zone (PKFZ) land deal.
Liow said that by reading the judgment reported, the High Court judge had found beyond any reasonable doubt that Dr Ling did not have any guilty mind (mens rea) in committing the alleged cheating.
In a statement, Lim had warned that the consequence of acquitting Dr Ling amounted to giving Cabinet Ministers a “blank cheque” to write off any misdeeds under their purview as all ministers will enjoy immunity on dereliction of duty.
