KOTA KINABALU: Warrants of arrest have been issued against a 13-year-old school girl and her father for failing to turn up at the Sessions Court as witnesses to the rape case involving restaurant manager Riduan Masmud.
The teenager and her father were supposed to testify in the trial of Riduan who was accused of statutory rape.
The incident was alleged to have occurred in a parked car at the Kionsom waterfall in Inanam near here on Feb 18 this year.
Deputy Prosecuting officer Raja Zaizul Zaharudin applied for the warrant after waiting half a day for the duo to turn up in court here on Wednesday.
Sessions court judge Ummu Kalthom Samad ordered for the warrant of arrest to be executed immediately as the father and daughter already knew they were supposed to turn up in court.
"The order is to be executed immediately and by that, it means they have to be in the Sessions Court by tomorrow and the victim is to be separated from any adult during the trial," she said.
The court also heard testimonies from nurse Salawati Saudi who assisted the doctors to examine and take vaginal swabs from the victim when she was brought in by the police after a rape report was lodged on Feb 18.
